Description
Real Estate Board; authority to hear fair housing violations by real estate licensees. Clarifies that in any case in which there are multiple respondents and one of the respondents is a real estate licensee, the case involving the real estate licensee and the respondent who is not a real estate licensee shall be heard by the Real Estate Board and not the Fair Housing Board. The bill also provides that in no event shall the jurisdiction be split between the Real Estate Board and the Fair Housing Board on the same such case. Read the Bill »

Comments
HB 1480 is a fair housing bill that the Coalition initially opposed. The bill contained broad language that raised concerns for us. Since then, we have been collaborating with REALTORS and others to find language that reinforces the consensus opinion that real estate licensees and their employees should have their fair housing cases heard before the real estate board but that also preserves the integrity of Virginia’s Fair Housing Law. We understand that the intent of the bill was to clarify current law not to shift policy. Our concern was with potential unintended consequences. We are very appreciative of the Patron of HB 1480, Delegate Peter Farrell, and industry groups involved who have spent time and energy working with us on this important issue. With revisions moving in the right direction, we expect to support the bill as it proceeds through the General Assembly this session.
