Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding in Chapter 14 of Title 22.1 an article numbered 6, consisting of sections numbered 22.1-289.01 and 22.1-289.02, as follows:

Article 6.
Virginia Longitudinal Data System.

22.1-289.01. Virginia Longitudinal Data System; established.

A. The Board shall establish, maintain, and operate the Virginia Longitudinal Data System.

B. The Virginia Longitudinal Data System shall track and examine a student's progress from early childhood to postsecondary education to the student entering the workforce.

C. The Board shall submit an annual report concerning the Virginia Longitudinal Data System to the General Assembly and the Virginia Workforce Council. This annual report may be incorporated as part of the report required by 22.1-18.

22.1-289.02. Virginia Longitudinal Data System Advisory Council; purpose; membership; meetings; subcommittees.

A. The Virginia Longitudinal Data System Advisory Council (the Council) is established as an advisory council, within the meaning of 2.2-2100, in the executive branch of state government. The purpose of the Council is to advise the Board on all matters related to the Virginia Longitudinal Data System.

B. The Council shall consist of the following nine members, or their designees, who shall serve ex officio with voting privileges: the Secretary of Education, the Superintendent of Public Instruction, the Director of the State Council of Higher Education for Virginia, the Chancellor of the Virginia Community College System, the Chief Information Officer of the Virginia Information Technologies Agency, the Commissioner of the Virginia Employment Commission, the Commissioner of the Virginia Department of Labor and Industry, the President and Chief Executive Officer of the Virginia Economic Development Partnership Authority, and the Commissioner of the Virginia Department of Social Services. Ex officio members of the Council shall serve terms coincident with their terms of office.

C. The Council shall be chaired by the Secretary of Education. A majority of the members shall constitute a quorum. The Council shall meet at least quarterly each year. Members shall be reimbursed for all reasonable and necessary expenses incurred in the performance of their duties as provided in 2.2-2813 and 2.2-2825. Funding for the costs of compensation and expenses of the members shall be provided by the Department of Education.

D. The Council shall convene subcommittees that shall include a steering subcommittee to consist of senior level representatives from agencies that provide data to the Virginia Longitudinal Data System and a data governance subcommittee to consist of appropriate subject matter experts from such agencies. The purpose of the steering subcommittee shall be to ensure the continued technical development of the Virginia Longitudinal Data System and its ability to ensure privacy and comply with current and emerging standards for technology. The purpose of the data governance subcommittee shall be to ensure data assets are formally managed for accuracy and privacy requirements.

E. The Department of Education shall provide staff support to the Council.
