SB786: Firearms, lost or stolen; duty of law enforcement.
Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 18.2-309.1 as follows:
§ 18.2-309.1. Lost or stolen firearms; duty of law enforcement.
Whenever a person reports the theft or loss of a firearm as defined in § 18.2-433.1 to the Department of State Police, any police department or sheriff's office, the officer or department receiving such report shall enter, to the extent such information is known by the officer or department, the appropriate information required by the Department of State Police, into the "information system" known as the Virginia Criminal Information Network (VCIN), established and maintained by the Department of State Police and the National Crime Information Center (NCIC), maintained by the Federal Bureau of Investigation.

Whenever a person reports the theft or loss of a handgun or assault firearm to the Department of State Police, any police department or sheriff's office, the officer or department receiving such report shall enter the appropriate information required by the Department of State Police into the "information system" known as the National Crime Information Center (NCIC), maintained by the Federal Bureau of Investigation.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 18.2-309.1 as follows:
18.2-309.1. Failure to report stolen firearm; civil penalty.
Any person who fails to report to a law-enforcement agency the theft or loss of a firearm that he owns or lawfully possesses within 48 hours of the time that he knew or reasonably should have known that such firearm had been lost or stolen is subject to a civil penalty of $250. The proceeds of such penalty shall be deposited into the Literary Fund.
For the purposes of this section "firearm" shall have the meaning as provided in 18.2-308.2:2.
