FLOOR AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding a section numbered 15.2-2402.1, relating to service districts.

Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 15.2-2402.1 as follows:

§ 15.2-2402.1. Change to service district boundaries.

Any locality, by majority vote of the governing body, may amend the boundaries of an established service district that lies wholly within that locality's boundaries. If more than one locality is involved in an established service district and those localities desire to amend that service district, a majority vote of the governing body of each locality affected by the amendment is required. Any locality or localities seeking to amend such service district boundaries shall follow the notice and public hearing requirements set out in § 15.2-2400.

A BILL to amend the Code of Virginia by adding in Article 1 of Chapter 24 of Title 15.2 sections numbered 15.2-2403.4 and 15.2-2403.5, relating to service districts.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 1 of Chapter 24 of Title 15.2 sections numbered 15.2-2403.4 and 15.2-2403.5 as follows:

§ 15.2-2403.4. Modifying boundaries of service districts.

A.  A service district may be enlarged to include any additional land within the district that would benefit from the facilities and services provided within the district. To enlarge a service district, the governing body of a locality shall adopt an ordinance in compliance with the procedures specified in § 15.2-2400 or file a petition for a court order in compliance with the procedures set forth in § 15.2-2401. Any ordinance or petition to enlarge a service district shall describe the proposed additional area to be included in the district in the manner specified in § 15.2-2402.

B. A service district may be reduced in size by excluding land from the district in the same manner by which the district was created. The governing body of the locality shall either adopt an ordinance in compliance with the procedures specified in § 15.2-2400 or petition for a court order in compliance with the procedures set forth in § 15.2-2401. Any ordinance or petition to reduce the size of a service district shall describe the proposed area to be excluded from the district in the manner specified in § 15.2-2402.

C. Actions of a locality to either enlarge or reduce the size or otherwise modify the boundaries of an existing service district that was properly created by that locality shall not affect, invalidate, or otherwise impair the existence or the powers of that service district.

§ 15.2-2403.5. Dissolution of service district; disposition of property.

Whenever the governing body of a locality determines that the purposes for which a service district was created have been substantially complied with and all bonds theretofore issued and all obligations theretofore incurred by the locality for the district have been paid, the governing body shall adopt an ordinance declaring such facts and that the district should be dissolved, and upon adoption of such ordinance the district shall stand dissolved.
