A BILL to repeal § 18.2-345 of the Code of Virginia, relating to lewd and lascivious cohabitation.

Be it enacted by the General Assembly of Virginia:

1. That § 18.2-345 of the Code of Virginia is repealed.

Be it enacted by the General Assembly of Virginia:

1.  That 18.2-345 of the Code of Virginia is amended and reenacted as follows:

18.2-345. Lewd and lascivious behavior.

If any persons, not married to each other, lewdly and lasciviously associate and cohabit together, or, whether married or not, be guilty of Any person who engages in open and gross lewdness lewd and lasciviousness, each of them shall be lascivious behavior is guilty of a Class 3 misdemeanor; and upon a repetition of the offense, and. A second or subsequent conviction thereof, each of them shall be guilty of under this section is punishable as a Class 1 misdemeanor.
