Description

Elections; vacancies in elected constitutional and local offices. Requires the court to order a special election for a vacancy in any elected constitutional or local office to be held on the date of the next general election, unless the governing body filing the petition for a writ of election requests in its petition a different date for the special election, in which case the court is required to order the election be held on that date if it complies with current law regarding times for special elections. However, if the vacancy occurs within 90 days of the next general election, the special election shall be held on the second general election, unless otherwise requested in the petition.
