Description

Pretrial appeals by Commonwealth. Provides that a petition for a pretrial appeal can be filed with the Court of Appeals not more than 14 days after the notice of the filing of a transcript or statement of facts is filed; under current law, the petition must be filed not more than 14 days after the actual transcript or written statement is filed. The bill provides that the notice of the filing of a transcript or written statement of facts by the attorney for the Commonwealth can be filed within three days of the filing of the transcript or written statement of facts or within 14 days of the order of the circuit court, whichever is later. The bill also removes the requirement that the Commonwealth be the filer of the transcript or statement of facts. Read the Bill »
