Description

Seizure of food and dairy products; sampling. Allows but does not require the Commissioner of Agriculture and Consumer Services to sample goods that have been seized because they are believed to violate the law; current law makes such sampling mandatory. If the Commissioner determines that a sample requires laboratory analysis, the bill requires that the sample be forwarded to the Division of Consolidated Laboratory Services of the Department of General Services (the Division) to be turned over to a qualified analyst. The bill provides that a certification of the results of the analysis by a qualified analyst employed by the Division shall constitute prima facie evidence of the facts certified to. Read the Bill »
