Description

Deemed consent for blood testing; minors. Provides that in cases in which a school board employee is directly exposed to body fluids of a minor, the minor will not be deemed to have consented to blood testing for HIV or the hepatitis B or C virus and the school board must obtain consent from a parent or guardian to obtain a specimen for purposes of testing. If such consent is denied or cannot be obtained, the bill permits the school board employee or his employer to petition the juvenile and domestic relations district court for a court order requiring the minor to provide a specimen for purposes of testing.
