Description

Condominium and Property Owners' Association Acts; statement of unit and lot owner rights. Provides that every unit owner under the Virginia Condominium Act and every lot owner under the Property Owners' Association Act, who is a member in good standing of the unit owners' association or property owners' association has the right (i) of access to all books and records kept by or on behalf of the association, (ii) to cast a vote on any matter requiring a vote by the association's membership in proportion to the unit or lot owner's ownership interest, (iii) to have notice of any meeting of the executive organ or board of directors and to participate in such meeting, (iv) to have notice of any proceeding conducted against the unit or lot owner to enforce any rule or regulation of the association and the opportunity to be heard and represented by counsel at such proceeding, and (v) to have all funds of the association managed in accordance with generally accepted fiduciary standards. This bill lays the groundwork to protect the rights of homeowners that live in HOA's that have been eroding due to efforts of the Community Association Institute and their Virginia lobbying arm, The Virginia Legislative Action Committee (VALAC) which I'm sure will fight hard to kill this.
This bill is more than symbolic it sends a clear message to the $70 billion per year HOA industry that homeowners have rights and that they should not be trampled on.
This bill needs to be passed.

The CAI and VALAC has gotten wind of this bill and their 'go to' person in Richmond is coming out swinging in opposition. Their paid lobbyists with the Lindl Corporation came out in full force, claiming that this just opens the doors to lawsuits. Sorry, all that homeowners living in these controlled communities really want is the right to the peaceful enjoyment of their homes and property.

I agree wholeheartedly with both Bob and Lucy. Homeowners have rights that should not be trampled on, and we deserve the right to the peaceful enjoyment of our homes and property. Further, CAI and VALAC are simply more lobbyists who are buying our government and our lives. They need to be stopped. Neither cares about homeowners. They simply want greater power and greater profit; and we are the source of their profit. Our pockets are being emptied by them. The harder we work, the more CAI and VALAC earn! ENOUGH!!
