An Act to amend and reenact § 1 of Chapter 277 of the Acts of Assembly of 2013, relating to the City of Charlottesville; authority to amend zoning ordinance.

Be it enacted by the General Assembly of Virginia:

1. That § 1 of Chapter 277 of the Acts of Assembly of 2013 is amended and reenacted as follows:

§ 1. The governing body of the City of Charlottesville may, as a part of its subdivision ordinance as authorized by § 15.2-2242 of the Code of Virginia, and as part of its zoning ordinance enacted pursuant to Article 7 (§ 15.2-2280 et seq.) of Chapter 22 of Title 15.2 of the Code of Virginia, include provisions allowing the subdivider or developer of a residential lot, or of a any lot containing at least one residential unit, the option of either (i) dedicating land for and constructing a sidewalk as specified in subdivision 9 of § 15.2-2242 or (ii) contributing to a sidewalk fund, maintained and administered by the city, funds equivalent to the cost of the dedication of land for and construction of a sidewalk on the property. Nothing in this act shall alter in any way any authority of localities or the Department of Transportation to require sidewalks on any newly constructed street or highway.
