A BILL to amend the Code of Virginia by adding in Article 1 of Chapter 9 of Title 15.2 a section numbered 15.2-926.3, relating to disposable plastic shopping bags.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 1 of Chapter 9 of Title 15.2 a section numbered 15.2-926.3 as follows:

§ 15.2-926.3. Prohibiting the provision of plastic shopping bags; certain retailers.

Any locality may by ordinance prohibit grocery stores, convenience stores, drug stores, hardware stores, and other similar retail establishments from providing disposable plastic bags to consumers, whether or not consumers are charged for such bags. No prohibition adopted under the authority of this section shall apply to durable plastic bags that are specifically designed and manufactured for multiple reuse, measure at least 2.25 mils thick, and have handles; or plastic bags that are sold in multiples and are intended to hold garbage, pet waste, or leaves or yard waste.
