Description
Voting equipment; locking and sealing of voting and counting machines after election. Provides that if a voting or counting machine secured by removal of a data storage device containing the only record of votes cast for any office or on any question and the machine itself does not contain such a record, that machine is not required to remain locked and sealed until the deadline to request a recount has passed or any contest or recount has been concluded. The sealed envelopes containin the equipment keys for such machines are required to be delivered to the electoral board no later than noon on the day following the election. The bill also provides that the requirements for locking and sealing voting equipment do not apply to any ballot marking device and its data storage device provided to meet accessibility requirements, where the number of persons voting in the election or the number of votes cast for any office or on any question are not recorded by the ballot marking device. HOUSE AMENDMENT. SENATE BILL 120 PASSED THE HOUSE WITH A SUBSTITUTE. SENATOR FROM GRAYSON, SENATOR CARRICO. THANK YOU, MR. PRESIDENT. MR. PRESIDENT, I ASK THAT WE REJECT THE SENATE SUBSTITUTE. THIS IS A BILL THAT WAS DEALING WITH THE ISSUANCE OF MAILING SUMMONS TO THE INDIVIDUAL FOR PASSING A SCHOOL BUS. THE CAMERAS ON THE BUS WOULD CAPTURE THE INDIVIDUAL PASSING THE VEHICLES AND THEN THEY WOULD BE ABLE TO MAIL A SUMMONS TO THAT INDIVIDUAL THAT VIOLATED THAT LAW AND IT WAS A CIVIL VIOLATION. THE HOUSE SUBSTITUTE TAKES OUT A LOT OF LANGUAGE THAT DIRECTS ANDTHE SENATOR FROM PETERSBURG, TORNADO DANCE. THANK YOU -- SENATOR DANCE. THANK YOU N PRESIDENT. I MOVE THAT THE SENATE CONCUR WITH THE HOUSE AMENDMENT AND SPEAKING BRIEFLY TO THE AMENDMENT. THE SENATOR HAS THE FLOOR. MR. PRESIDENT, THE HOUSE AMENDMENT JUST ADDS ON LINE 50 AFTER MACHINE, EACH SUCH MACHINE SHALL REMAIN LOCKED AND SEALED UNTIL IT IS RETURNED TO THE SITE AT WHICH VOTING AND COUNTING MACHINES ARE STORED IN THE LOCALITY. THIS WAS THE RECOMMENDATION OF THE GOVERNOR AND DEPARTMENT OF ELECTIONS AND WITH THIS AMENDMENT, THIS BILL AND MY BILL ARE NOW IDENTICAL.
