A BILL to direct the Secretary of Commerce and Trade to work with the Virginia-Israel Advisory Board and other related organizations to implement practices related to the Boycott, Divestment and Sanctions movement.

Be it enacted by the General Assembly of Virginia:

1. § 1 That the Secretary of Commerce and Trade shall work with the Virginia-Israel Advisory Board to implement practices that will ensure free, fair, open, and consistent business practices related to the Boycott, Divestment and Sanctions movement (BDS) and how such movement could affect existing Virginia businesses and Virginia's ability to attract new investment and jobs to the Commonwealth.

A BILL to direct the Secretary of Commerce and Trade to work with the Virginia-Israel Advisory Board and other related organizations to review issues related to the Boycott, Divestment and Sanctions movement; report.

Be it enacted by the General Assembly of Virginia:

1. § 1 That the Secretary of Commerce and Trade shall work with the Virginia-Israel Advisory Board to review issues related to the Boycott, Divestment and Sanctions movement (BDS) and how such movement could affect existing Virginia businesses and Virginia's ability to attract new investment and jobs to the Commonwealth. The Secretary shall report his findings to the Chairmen of the House and Senate Committees on Rules and Commerce and Labor, and the House Committee on General Laws and the Senate Committee on General Laws and Technology by December 1, 2016.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 2.2-4311.3 as follows:

§ 2.2-4311.3. Required contract provision; persons participating in the boycott of Israel.

A. All state public bodies shall include in every contract of more than $10,000 the following provisions:

1. During the performance of this contract, the contractor agrees that the contractor will not engage in the boycotting of Israel and, further, that the contractor will not contract or subcontract with any person, firm, or corporation that engages in the boycotting of Israel; and

2. The contractor will include the provisions of subdivision 1 in every subcontract or purchase order of more than $10,000, so that the provisions will be binding upon each subcontractor or vendor.

B. For the purposes of this section, "boycotting of Israel" means refusing to deal with, terminating business activities with, or taking other actions that are intended to penalize, inflict economic harm, or otherwise limit commercial relations with Israel.
