VIRGINIA ACTS OF ASSEMBLY -- CHAPTER
An Act to amend the Code of Virginia by adding a section numbered 22.1-79.7, relating to local school boards; public school choice.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 22.1-79.7 as follows:

§ 22.1-79.7. Public school choice.

Notwithstanding any agreement, waiver from the federal government, or provision of law to the contrary, the Board, effective starting with the 2017-2018 school year, shall select 12 schools identified for comprehensive support and improvement under § 1111(c)(4)(D)(i) of the Elementary and Secondary Education Act of 1965, as amended, and require such schools to provide all enrolled students with the option to transfer to another public school in the school division in accordance with §§ 1111(c)(4)(D)(ii) through 1111(c)(4)(D)(v) of the Elementary and Secondary Education Act of 1965, as amended, and subject to any conditions and limitations established by the relevant local school board in accordance with subdivisions A 1 and A 3 through 8 of § 22.1-7.1.

2. That the provisions of the first enactment of this act shall not become effective unless reenacted by the 2017 Session of the General Assembly.

3. That no later than November 1, 2016, the Board of Education shall report to the Chairmen of the House Committee on Education and the Senate Committee on Education and Health on the cost, if any, to the Board of Education, the Department of Education, or local school boards to implement the provisions of this act and any other matters relating to the implementation of this act.

Notwithstanding any agreement, waiver from the federal government, or provision of law to the contrary, each local school board shall provide all students enrolled in a public school in the school division that is identified by the Commonwealth for comprehensive support and improvement under § 1111(c)(4)(D)(i) of P.L. 114-95 with the option to transfer to another public school in the school division in accordance with § 1111(c)(4)(D)(ii) through § 1111(c)(4)(D)(v) of P.L. 114-95.
