Description

Sex or gender discrimination; applicable federal law. Provides that for the purposes of the Virginia Human Rights Act, an "unlawful discriminatory practice" shall not include conduct that violates any federal administrative policy, rule, or regulation adopted on or after January 1, 2012. The ACLU of Virginia strongly opposes this bill. This bill is a thinly veiled attempt to prohibit local governments and school boards from protecting their employees, residents, and students from discrimination on the basis of sexual orientation and gender identity and to deny employees of smaller employers basic protections from discriminatory discharge. It is sad to see the number of bills introduced this session targeted at ensuring that schools and other governmental agencies can purposely discriminate against transgender adults and children in Virginia. At a time when we should be working to end discrimination against all LGBT Virginians, and in a state where the overwhelming majority of Virginians agree that such discrimination should end, these bills are nothing more than ineffective, mean-spirited efforts to deny LGBT people in Virginia their constitutional and human rights.
