SB227: Environmental Quality, Department of; toxic waste site inventory.
Be it enacted by the General Assembly of Virginia:
1. That § 10.1-1186.1 of the Code of Virginia is amended and reenacted as follows:
§ 10.1-1186.1. Department to publish toxics inventory.
A. The Department of Environmental Quality shall
publish in March of each year the information reported by industries pursuant
to 42 U.S.C. § 11023 in its document known as the "Virginia Toxic Release
Inventory." The report shall be (i) organized by chemical, facility and
facility location, and standard industrial classification code, and (ii)
distributed to newspapers of general circulation and television and radio
stations. The report shall include the information collected for the most
recent calendar year for which data is available prior to the March publication
date.
B. The Department shall publish by July 1, 2017, a report of identified waste sites in the Commonwealth in a document known as the "Virginia Waste Site Inventory." The report shall consist of a listing of sites within the Commonwealth that the Department is aware of and that have (i) managed a solid waste, hazardous waste, hazardous substance, or other substance within the jurisdiction of the Waste Management Board or (ii) been required or volunteered to conduct a remedial action under an order or regulations of the Waste Management Board. The report shall contain, if known, the site location, type of waste management, time period of management, remedial action, corrective action, or closure, if any, taken at the site; impediments to remedial action, corrective action, or closure, if any; and any other information the Department determines is relevant for the report.
[ 2. That the provisions of this act shall not become
effective unless an appropriation effectuating the purposes of this act is
included in a general appropriation act passed in 2016 by the General Assembly
that becomes law. ]
