Description

Nutrient credit certification; priority consideration. Directs the State Water Control Board (the Board) to establish a system for priority consideration of an application for a land conversion project, with a $10,000 fee. The Department of Environmental Quality will be required to review such a priority application ahead of normal applications and approve it within 30 days. The bill also directs the Board to certify credits that are located in tributaries outside the Chesapeake Bay Watershed. Amends § 62.1-44.19:20, of the Code of Virginia. Read the Bill »

SENATOR FROM AUGUSTA, SENATOR HANGER. THANK YOU, MR. PRESIDENT. MR. PRESIDENT, WE HAVE A ROBUST NUTRIENT CREDITING PROGRAM IN THE CHESAPEAKE BAY WATERSHED AREA. THIS BILL, SENATE BILL 443, SETS UP A NUTRIENT CREDIT EXCHANGE PROGRAM IN THE SOUTHERN RIVERS BY ESTABLISHING AN EXPEDITED PROCESS FOR CERTIFYING NUTRIENT. THE BILL HAS IT LEFT THE SENATE ENVISIONED A FEE THAT WOULD SET UP A STED DIETED PROCESS -- EXPEDITED PROCESS. THE HOUSE AMENDMENTS REMOVED THAT FEE AND INSTEAD SET UP A TIME-SPECIFIC TABLE FOR THESE CREDITS TO BE CERTIFIED, SO I AGREE WITH THAT PARTICULAR EXCHANGE AND MOVE WE CONCUR WITH THE HOUSE AMENDMENT.
