Description

Liability of sanctuary cities for certain injuries and damages. Provides that a sanctuary city, defined in the bill as any locality that adopts any ordinance, procedure, or policy that restricts the enforcement of federal immigration laws to less than the full extent permitted by federal law, shall be jointly and severally liable for the tortious injury to persons or property caused by an illegal alien within such locality. LAST YEAR, I PUT IN A BILL THAT WAS, FRANKLY, NOT READY FOR PRIME TIME. FORTUNATELY THE SENATOR FROM BEDFORD ASKED SHEV AND THE TREASURY DEPARTMENT TO COME BACK AND LOOK AT THE BILL WITH RECOMMENDATIONS. THIS IS BILL IS BASED ON THE RECOMMENDATIONS. IT WOULD LICENSE STUDENT LOAN SERVICERS AND THOSE THAT DO NOT MEET CERTAIN STANDARDS COULD LOSE THEIR LICENSURE OR IF THEY DID ENGAGE IN CERTAIN PROHIBITED ACTIVITIES THIS HE COULD LOSE LICENSURE. AND IT COULD GIVE STATE OVERSIGHT TO THE WHOLE ISSUE. THE LICENSING AGENCY WOULD BE THE BUREAU OF FINANCIAL INSTITUTIONS AND THE FCC. IT IS A SELF-FUNDED BILL. THOSE WHO ARE LICENSED WOULD PAY THE FEES. IT IS NOT ESTIMATED TO BE PARTICULARLY HIGH, BUT THIS DOES GIVE A LOT OF PROTECTIONS TO OUR STUDENT LOAN BORROWERS. THANK YOU, SENATOR. WHAT THIS BILL DOES IS ALLOWS INDIVIDUALS WHO WERE ONCE TANIT RECIPIENTS AND PARTICIPATING IN THE VIEW PROGARAGE THE VIRGINIA INITIATIVE FOR EMPLOYMENT AND NOT WELFARE ALLOWS THE INDIVIDUALS TO CONTINUE TO RECEIVE SUPPORT SERVICES SUCH AS CHILD CARE SUBSIDIES FOR 24 MONTHS RATHER THAN 12 MONTHS. THIS WAS A UNANIMOUS RECOMMENDATION FROM THE COMMISSION ON YOUTH AND IN FACT THERE WAS A COMMITTEE AND I CHAIRED THIS COMMITTEE TO LOOK AT ALL OF OUR TANIT FOUNDED PROGRAMS AND HOW TO DETERMINE HOW WE CAN BEST SHAPE THE PROGRAM SO INDIVIDUALS CAN REMAIN SELF SUFFICIENT. AND TO THE PERSON ON THE COMMITTEE WE FELT THAT EXTENDING THIS 12 MONTHS TO 24 MONTHS WOULD REALLY BE INVALUABLE BECAUSE MANY CERTIFICATE PROGRAMS TAKE 24 MONTHS TO COMPLETE. THE FISCAL IMPACT IS VERY THE BULK OF THE MONEY WOULD COME MINIMAL. OUT OF THE FUNDS, A VERY SMALL PERCENTAGE COMES OUT OF GENERAL FUNDS. AND I WILL JUST SAY A REPORT WAS ISSUED IN 2016 AND OF THE 61% OF THE INDIVIDUALS WHO WERE EMPLOYED THROUGH THE V.I.E.W. PROGRAM, THE AVERAGE SALARY WAS ONLY $8.86. THAT IS NOT ENOUGH TO SUPPORT A FAMILY SO I ASK THE LADIES AND GENTLEMAN OF THE SENATE TO TAKE A STEP FORWARD AND TRY TO HELP US BREAK THE CYCLE OF POVERTY AND TO SUPPORT THIS BILL. THANK YOU, MR. I WOULD SAY IMPORTANTLY THAT THIS WILL BECOME A USEFUL TOOL TO PROVIDE INFORMATION FOR PARENTS SO THAT THEY KNOW WHAT PROGRAMS ARE OVERSEEN BY THE STATE AND WHAT PROGRAMS ARE EXEMPT. I WOULD SAY ALSO, MR. PRESIDENT TO BE CLEAR THIS DOES NOT EXTEND EXEMPTIONS OR TAKE AWAY EXEMPTIONS FROM PROGRAMS THAT ARE CURRENTLY EXEMPT SO THAT IN YOU HAVE A RELIGIOUS EXEMPT DAYCARE PROGRAM COME AND GOES DAY AND A HALF CAMPS YMYA THOSE REMAIN EXEMPT FROM DO TOWARDS TH SAFETY PROTOCOL IN THE DEPARTMENT OF SOCIAL SERVICES TO CERTIFY THAT. ACLU-VA opposes this bill. Virginia already has some of the strictest laws in the nation regarding local compliance of federal immigration laws. This bill does nothing except to expose localities to liability for the actions of a private individual, setting a dangerous precedence under tort law.

SB1262 cedes vital state and local sovereignty to federal agencies. It invites the federal government to commandeer local resources in pursuit of federal priorities, regardless of the effects on local communities. How in the world is that a good thing? I can only think that it is motivated by xenophobia. Please defeat this bill!
