Del. Todd Gilbert (R-Woodstock): thank you, Mr. Speaker. ladies and gentlemen of the house ladies and gentlemen of the house will allow the virginia sheriff's association to negotiate and provide cap rative purchasing. It would -- cooperative purchasing. Only elected sheriffs are eligible to be members of the sheriff's association. This treats it like the metropolitan council of governments an independent nonprofit association which already enjoys this privilege and I would move the bill pass.

Del. David Bulova (D-Fairfax): thank you, Mr. Speaker. Speaking to the bill.

Del. Bill Howell (R-Fredericksburg): the gentleman has the floor.

Del. David Bulova (D-Fairfax): Mr. Speaker, ladies and gentle men of the house, this has nothing to do with the sheriff's association. It has more to do with the transparency in the public procurement process. I always had mixed feelings about cooperative purchase and contract riders. When you think about it, it is kind of a double edged sword for the locality report public body they might get economy to scale and certainly save some administrative costs but in a way it is a little bit on the anticompetitive said for businesses. So if you are a business, particularly a small business and you Miss Out on bidding for a larger contract, chances are you will be locked out with regard to doing business for a lot of other localities and other public agencies. And in fact, over the last couple of years we back tracked on cooperative purchasing. And so you are no longer to do cooperative purchasing for architectural engineering standards. Last year we took out turf fields with regard to cooperative purchasing. The one saving grace when it comes to public agencies, though, is that we know it is subject to our public procurement processes. When you go through the initial exercise you know it was a competitive process and had some kind of notification out there. You know that it is open to foia and you know also I think most importantly it is open to some kind of public audit. This bill really takes us in a whole new direction not withstanding the metropolitan washington council of governments what we are doing here is further privatizing the public procurement process. With this what we are seeing is losing out on and abandoning the principles of public procurement. No longer are we going to have protections from the procurement laws. No longer is there anything that there was a guarantee of that competitive process. That means you less transparency and you have less competition for public dollars. This might seem like a small step but I would hope that everybody would think carefully about the pandora's box that we are opening and the whole range of other nonprofits that might come in next years and the years after to do something lake this. mr. Speaker, I hope that we would not pass this bill.

Del. Barry Knight (R-Virginia Beach): Mr. Speaker, speaking to the measure.

Del. Bill Howell (R-Fredericksburg): the gentleman has the floor.

Del. Barry Knight (R-Virginia Beach): Mr. Speaker, what this bill does, it gives the sheriff's association to go in and be allowed to buy vehicles for localities. The lowe calitys don't have to by from the sheriff's association. They can buy from the state procurement process. What it will do, the state charges 1.5%. The sheriff's association will have half that much. Three quarters of one percent which equates to about $300 per vehicle. The sheriff's association's books are open all the time for anyone to see. The locality certainly isn't going going to pay more money so it makes it more competitive. I am for free enterprise and a more competitive bid process and I'm for saving the sheriff's departments in localities more moneys. Please vote for this bill.
