[Unknown]: THE COMMONWEALTH OPPORTUNITY FUND FORMERLY CALLED THE GOVERNOR'S OPPORTUNITY FUND HAS PROVIDED FUNDING FOR A LOT OF VERY GOOD PROJECTS IN THE COMMONWEALTH OF VIRGINIA. FROM JANUARY 2014 TO DATE, A TOTAL OF 96 PROJECTS HAVE RECEIVED COMMONWEALTH OPPORTUNITY FUND GRANTS. 64 OF THOSE PROJECTS ARE 67% OF ALL OF THE PROJECTS HAVE CREATED JOBS THAT EXCEED THE LOCALITY'S PREVAILING WAGE. MR. SPEAKER, LADIES AND GENTLEMEN OF THE HOUSE, WE WANT A BUDGET THAT BUILDS A NEW VIRGINIA ECONOMY THAT PROVIDES ECONOMIC OPPORTUNITY THAT CROSS-SECTIONS OF VIRGINIA AND PROVIDES FOR WORKING FAMILIES. AND IF YOU TAKE A LOOK AT THESE PROJECTS, 12,400 OF THE JOBS CREATED SINCE 2014 WERE OVER THE LOCALITY'S PREVAILING WAGE. THESE INCLUDED THE NAVY FEDERAL CREDIT UNION RECENT INITIATIVE. 1400 JOBS AT SALARIES, 4500 PROVIDED IN THE PREVAILING WAGE. DOLLAR TREE. 189% HIGHER THAN THE LOCALITY PREVAILING WAGE. ELDER CORPORATION IN BOTETOURT COUNTY. 350 JOBS. 32% HIGHER THAN THE PREVAILING WAGE. AND LETIL AND MCKESSON. PRETTY GOOD, HUH? THESE WERE ALL FUNDED IN PART THROUGH THE GOVERNOR'S OPPORTUNITY FUND. WE CAN'T LEAVE THESE CRITICAL INCENTIVES OUT OF THE BUDGET BECAUSE IT LIMITS THE GOVERNOR AND HIS STAFF FROM PROVIDING THE ASSISTANCE NECESSARY TO CREATE GOOD JOBS IN THE NEW VIRGINIA ECONOMY. MR. SPEAKER, I HOPE THAT YOU WILL RESTORE THE MONEY AND VOTE NAY ON THIS OBJECTION. MR. O'BANNON. SPEAKING TO THE AMENDMENT.

David Toscano (D-Charlottesville): AGAIN, THIS AMENDMENT IS FOCUSED ON BUILDING THE NEW VIRGINIA ECONOMY AND CREATING GREATER ECONOMIC OPPORTUNITY FOR THE BROADEST CROSS-SECTIONS OF VIRGINIA, VIRGINIANS. AND LET ME TELL YOU A LITTLE BIT ABOUT THE BIOSCIENCE AND WHAT IT HAS DONE HERE IN VIRGINIA OVER THE LAST SEVERAL YEARS. SINCE THE CREATION OF THE BVHRC, THREE YEARS AGO, THERE HAVE BEEN GRANTS AND COLLABORATION MADE WITH INDUSTRY TO A LOT OF OUR GREAT RESEARCH INSTITUTIONS TO ACCELERATE THE COMMERCIALIZATION OF BIOMEDICAL UNIVERSITY RESEARCH. NOW, THERE HAVE BEEN SOME 18 PROJECTS IN FIVE ROUNDS OF FUNDING OVER THE LAST SEVERAL YEARS INVOLVING SIX RESEARCH UNIVERSITIES AND 15 INDUSTRY PARTNERS. THE MONEY THAT WE PUT IN THE BUDGET HAS LEVERAGED SOME $20 MILLION IN PRIVATE FUNDS AND ANOTHER $80 MILLION SCHEDULED TO COME FOLLOWING THIS INVESTMENT. NOW, LAST YEAR WE AUTHORIZED THIS GROUP TO UNDERTAKE A SECOND MAJOR ACTIVITY AND THAT WAS CALLED THE VIRGINIA NEUROSCIENCE INITIATIVE. NOW THIS IS A FORMAL COLLABORATION AMONG OUR UNIVERSITIES AND HEALTHCARE SYSTEMS AND PRIVATE INDUSTRY TO SHARE INFORMATION AND CREATE A COMMON SET DATA SO THAT WE CAN IMPROVE NEUROSCIENCE AND DO CLINICAL TRIALS IN VIRGINIA. NOW, THE ADDITIONAL $2.5 MILLION PASSED IN LAST YEAR'S BUDGET WOULD MAKE A DIFFERENCE AND GET THIS UNDERWAY. BUT THE HOUSE APPROPRIATIONS COMMITTEE HAS STRUCK THIS MONEY FROM THE BUDGET AND WE BELIEVE THAT IS SHORT-SIGHTED BECAUSE IF WE ARE GOING TO BECOME LESS DEPENDENT ON FEDERAL FUNDING, WE HAVE TO DO MORE WITH OUR BIOSCIENCE GROUPS IN THE COMMONWEALTH. THE OTHER THING I MIGHT SAY, MRE OF THE ECONOMIC INCENTIVES THAT WE HAVE IN VIRGINIA, EVERY ONE OF THE INVESTMENTS MADE WITH THESE PROJECTS IS PEER REVIEWED. I WAS TOLD UNDER NO CERTAIN CIRCUMSTANCES SHOULD I RISK HAVING ANOTHER BABY THAT I WAS VERY LIKELY AT HIGH RISK FOR HAVING THE SAME THING CALLED THE HELP SYNDROME. IN 2017, I RISE TO ASK AGAIN WHERE IS YOUR PLAN TO PROVIDE FOR THE HEALTHCARE NEEDS OF VIRGINIA FAMILIES OFTEN WORKING 40 OR 50 HOURS A WEEK SOMETIMES AT MULTIPLE JOBS OFTEN WHERE THEY DON'T HAVE ACCESS TO TRADITIONAL BENEFITS AND PLANS AND CAN'T SIGN UP FOR EMPLOYER HEALTH INSURANCE AND SO FORTH. NOW I UNDERSTAND THAT 2017 IS A NEW DAY AS FAR AS THE AFFORDABLE CARE ACT IS CONCERNED. THE PRESIDENT PROMISED TO REPEAL THE AFFORDABLE CARE ACT AND THAT PROCESS HAS BEGUN. THERE IS TWO PARTS TOSS THAT, RIGHT? IT IS SUPPOSED TO BE REPEAL AND REPLACE. SO MY QUESTION IS WHAT IS THE REPLACEMENT GOING TO LOOK LIKE? AND WE DON'T KNOW. WE DON'T KNOW. BUT I HAVE A GOOD FEELING THAT IT IS GOING TO INCLUDE SOME FORM OF MEDICAID EXPANSION. WHY DO I THINK THAT? WELL, PRESIDENT TRUMP IS NOT THE FIRST CANDIDATE TO CAMPAIGN ON A PROMISE TO ELIMINATE THE AFFORDABLE CARE ACT AND ELIMINATE MEDICAID EXPANSION. WE HAD GOVERNORS IN KENTUCKY AND ARKANSAS WHO BOTH PROMISED THE FIRST ACT AS GOVERNOR WAS TO ROLL BACK THE OBAMA MEDICAID EXPANSION. YOU KNOW WHAT HAPPENED IN BOTH CASES? ANY GOT INTO OFFICE AND REALIZED IT WASN'T GOING TO BE THAT EASY TO TAKE AWAY HEALTH INSURANCE FOR ALL THESE PEOPLE COVERED UNDER THE MEDICATION EXPANSION. WHAT DO THEY DO? IN BOTH CASES, KENTUCKY AND ARKANSAS THEY CHANGED THE NAME. THEY DID NOT CALL IT OBAMA CARE OR THE AFFORDABLE CARE ACT. THEY CALLED IT SOMETHING ELSE BUT IT WAS MEDICAID EXPANSION WHERE YOU COULD DRAW DOWN MEDICAID FUNDS. IN KENTUCKY THEY ADDED A REQUIREMENT THAT YOU LOOK FOR A JOB AND SEEK EMPLOYMENT. THE OFFICIAL ANSWER I MAY GET IS LAST YEAR THE BUDGET INCLUDED ID PRO PILOT PROJECTS IN SIX JAILS AND WE NEED TO WAIT UNTIL WE LOOK AT THESE PILOT PROJECTS. THOSE PROJECTS WERE TO PROVIDE SERVICES QUOTE UNQUOTE OR TO PREVENT MENTALLY ILL OFFENDERS FROM ENTERING JAIL. THAT ITEM OF LAST YEAR FOCUSES ON THE REST OF THE STORY BEHIND THE 20% OF OUR LOCAL JAIL POPULATION THAT HAVE SERIOUS MENTAL HEALTH NEEDS AND THAT IS TO QUOTE A NATIONAL SOURCE. THIS FUNDING ORDER THE GOVERNMENT INCLUDED DESPITE THE DEMANDS ON THIS VERY TIGHT BUDGET IS ABOUT THE DESPERATION OF WHERE WE ARE. THIS AMENDMENT IS A CRUCIAL FIRST STEM SIMPLY TO IDENTIFY WHO IN THE TENS OF THOUSANDS OF PERSONS ADMITTED TO A JAIL DURING THE YEAR WHO NEED MENTAL HEALTH. IT DOESN'T TAKE AN INVESTIGATION TO KNOW ONE OF THE MANY ELEMENTS IN THE DEATHS OF 24-YEAR-OLD 24 JAMICHAELMITCHELL, JAILED FOA CANDY BAR AND 37-YEAR-OLD NATASHA KENNA. OF PETE EARLY'S SON MIKE. PETE WHO WAS A 20 YEAR REPORTER WHO TOOK MIKE'S TRAGEDY, NOW MIKE SURVIVED THE JAILING. LAST YEAR WE DID PASS MONEYS FOR PILOT PROJECTS. $3.5 MILLION FOR THE MEANT TAL HEALTH ASSESSMENTS IN THE LOCAL JAILS. THESE WOULD OCCUR AND ARE STARTING IN OH NURSE CHESTERFIELD, HAMPTON ROADS, MIDDLE RIVER, RICHMOND CITY, WESTERN VIRGINIA AND PRINCE WILLIAM COUNTY. A STATEWIDE INITIATIVE. WE ALSO PASSED THE GENTLEMAN FROM PORTSMOUTH LEGISLATION, HOUSE BILL 2231 TO REVIEW MLUs BETWEEN JAILS AND CSBs TO ENSURE PREADMISSION SCREENING. AND THIRD, OTHER LANGUAGE IN THE BUDGET AMENDMENTS BEFORE YOU ASKED DCJS TO UPDATE TRAINING STANDARDS FOR ALL LAW ENFORCEMENT. Del. Bobby Orrock (R-Thornburg): this has the intent of treating private education programs the same as public education program. Private school education programs have to receive accreditation. Those accrediting entities are approved by the state department of education and what we are doing is making clear that these are not child daycare programs but rather truly educational programs. The only difference you see in the measure before you that was resolved in conference between the house version we saw earlier is we have one additional requirement on page 4 of the substitute where we build in pupil to instructor ratios and are holding montessori programs which are some what of a different educational model exempt from those same requirements. Del. Dave Albo (R-Springfield): this is controversial. It is entirely boring but it is controversial. I feel like it is my duty to tell you what is in it. This deals with the about topic of about when a public body, local government state or higher education wants to build a public building. The law says you are supposed to build it using competitive sealed bids. Get the designs and put out a request for proposals or an rfp and people submit how much money they will ask for in exchange for building that building. That way you get the best bang for your buck. Now, there are certain types of projects that can't be done that way because they are highly complex or historical so the best idea to get in your head is what happens when you redo the rotunda at uva which is one of the ten architectural master meess of the world. You can't do a competitive sealed bid so they use these orthians called construction management at risk, okay. Now there has become some controversy because the smaller contractors believe that a lot of government buildings are being built using this construction management risk when they are really not that complex. For example, you shouldn't be using these alternative things to build a parking deck because that is pretty easy to do. I told you it was going to be boring but you got to know because you will have some people call. So, the reason the small contractors are upset is because they don't have the ability to do a construction management at risk. That requires having an engineer on staff, it requires having an architect and all this other stuff that small contractors can't do. They believe they are being squeezed out of business and they presented evidence that in higher education 90% of the buildings over $5 million have been built using this construction management risk. 90%. And what their point is, that is impossible, something it wrong. So we have been arguing about in in general laws for three years. We created a study committee basically a government procurement study committee that the gentleman from suffolk chaired and when he went to appropriations it got laid on my lap and that is why I'm boring you with the story. It is longer than the budget talk. [Laughter]

[Unknown]: so what this bill does is not what the small contractors 100% wanted and it is not what higher education 1% hundred percent wanted, it as compromise. If you use a construction program other and competitive sealed bids you have to submit the proposal to the department of general services and they have to analyze the proposal to be sure that this project is complex and they will issue a statement it is complex, you can use this or it is not complex and you shouldn't use it. And if the public body still wants to do it they have to file a report. What we are hoping is that this is going to solve the problem because it will put sunlight on it. Sunlate light is government's great disinfectant. We are hoping if the puck lick bodies have to put in writing why they did this we think that the bad acting will stop. I hope it would be the pleasure of the house to adopt the conference report.
