Description

Filling vacancies in the United States Senate. Removes the language limiting the date at which a special election can be held to fill a vacancy occurring in the representation of the Commonwealth in the United States Senate. The bill also removes the authority of the Governor to make a temporary appointment to fill such a vacancy. The bill allows the Governor to immediately issue a writ to call an election upon receipt of written notification by a Senator or Senator-elect of his resignation and makes such resignation irrevocable after the date stated by him for his resignation or after the forty-fifth date before the date set for the special election. [Unknown]: WILL THE GENTLEMAN YIELD? DOES THE GENTLEMAN HAVE A DOG WHISTLE? GENTLEMAN YIELDS. MR. CHAIRMAN, MR. SPEAKER, I WAS JUST GOING TO ASK THE GENTLEMAN ABOUT THE COST OF THIS, BECAUSE I WAS LOOKING AT THE FISCAL IMPACT STATEMENT. THE REASON IT H NO FISCAL IMPACT IN OUR COMPUTER HERE IS THERE IS NO COST TO THE DEPARTMENT OF CORRECTIONS. HOWEVER, WHEN WE HAVE RESPONSIBLE PRISONERS IN OUR LOCAL JAIL WE PAY A DAILY RATE FOR THOSE. AND I BELIEVE THE GENTLEMAN WAS REFERRING TO THIS UNFUNDED MANDATE WHEN HE TALKED ABOUT CONGRESS TO HELP PAY FOR THIS, BECAUSE THIS IS REALLY, YOU ARE REALLY TELLING US THIS IS AN UNFUNDED MANDATE. I WANTED TO MAKE SURE WE GOT THAT ON THE RECORD. BECAUSE WE ARE NOT PAYING FUTURE JAILS TO PAY FOR INMATES. EVERY LOCALITY THAT ENTERS INTO THIS AGREEMENT IS IN FACT USING THEIR RESOURCES TO ENFORCE A FEDERAL LAW. SOY THEY ARE ALREADY DOING MOREOVER, IT IS NOT CORRECT TO THAT. STATE NO FELONS WERE RELEASED, BECAUSE THEY WERE. 16 DURING THIS TIME PERIOD. IT IS ALL RIGHT NOT CORRECT TO STATE THAT EVERYBODY IS JUST WILLY-NILLY DEALING WITH THIS. ALL OF VIRGINIA, ONLY FOUR JURISDICTIONS ARE IN STRICT COMPLIANCE. WHAT THAT MEANS RIGHT NOW, THE GREAT MAJORITY OF VIRGINIA LOCAL ITS, PROBABLY 125 -- LOCALITIES ARE LARGELY DEFINED BY THEIR NON-COMPLIANCE WITH I.C.E. DETAINERS. HOW DOES IT MAKE THE COMMUNITY SAFE EVEN IF YOU HAVE TO PAY FOR THESE INDIVIDUAL'S INCARCERATION FOR TWO MORE DAYS TO RELEASE INDIVIDUALS WHO ARE WANTED BY THE FEDERAL GOVERNMENT FOR SOME VIOLATION? SPEAKER? SPEAK TO THE BILL AT THE APPROPRIATE TIME.
