Description

Sanitary districts; creation by board of supervisors. Transfers authority to create or enlarge sanitary districts from the circuit court with jurisdiction over the locality in which the district is located to the governing body of the county or city in which the district is located. The bill requires the governing body, at a hearing for the creation or enlargement of a sanitary district, to make a finding of fact of whether the action is necessary, practical, fiscally responsible, and supported by at least 50 percent of persons who own real property in (i) the proposed district or (ii) in the case of enlargement, the area proposed to be included in the existing district. The bill also requires a minimum standard regarding timeliness for hearings. Read the Bill »

Del. Chris Peace (R-Mechanicsville): SINCE THE TREATY OF MIDDLE PLANTATION IN 1677. SO, WHEN MEMBERS OF THESE TRIBES WANT TO SEEK TO PURCHASE NEW LANDS AND ADD BACK PROPERTY THAT HAD BEEN THEIRS, THIS BILL WILL ALLOW THEM A MORE STREAMLINED PROCESS AROUND DGS SIMPLY WITH REVIEW OF THE SECRETARY OF THE COMMONWEALTH AND APPROVAL BY THE GOVERNOR. MR. SPEAKER, I WOULD MOVE THAT THE BILL BE ENGROSSED AND PASSED TO ITS THIRD READING.
