Description

Assisted living facilities; cap on civil penalties. Increases the aggregate amount of civil penalties that the Commissioner of the Department of Social Services may assess against an assisted living facility for noncompliance with the terms of its license from $10,000 per 24-month period to $10,000 per 12-month period. FACTORS. ONE IS THAT IT WILL BE DETERMINED BY LESS THAN 200% OF POVERTY AND NUMBER TWO IS THAT IT WILL BE DETERMINED AS ON THE MEDICARE RATE STRUCTURE. THIS BILL AS CURRENTLY SET UP WILL GIVE US THE INFORMATION BACK TO THE GENERAL ASSEMBLY NEXT YEAR AND WILL CONTINUE TO PUSH INFORMATION FORWARD WITH VHI'S HELP. I KNOW THERE IS CONTINUING WITH THE SENATOR FROM SOUTHERN FAIRFAX AND SENATOR FROM HENRICO WORKING AND I'M ANTICIPATING THAT THE BILL WILL ULTIMATELY GO TO CONFERENCE TO WORK OUT THE LAST DETAILS.
