RESOLVED by the House of Delegates, the Senate concurring, a majority of the members elected to each house agreeing, That the following amendment to the Constitution of Virginia be, and the same hereby is, proposed and referred to the General Assembly at its first regular session held after the next general election of members of the House of Delegates for its concurrence in conformity with the provisions of Section 1 of Article XII of the Constitution of Virginia, namely:

Amend the Constitution of Virginia by adding an article numbered XI-A, consisting of a section numbered 1, as follows:

ARTICLE XI-A
GAMING

Section 1. Enactment of casino gaming laws.

No bill permitting, authorizing, or establishing gaming involving house-banked gambling, player-banked gambling that simulates house-banked gambling, slot machines, or any electronic gambling devices, including video lottery, having been passed by both houses, duly enrolled, and signed by the Governor, shall become law until it has been submitted to the qualified voters at an election, in such manner as the General Assembly shall prescribe, and a majority of those voting on the question have voted in favor of the bill. However, such requirement shall not be construed to limit (i) the right of the General Assembly to exercise its authority to restrict, regulate, or tax any gaming activities, nor (ii) the ability of the Commonwealth or Native American tribes to negotiate gaming compacts pursuant to federal law for the conduct of casino gaming on tribal lands, or to affect any existing gaming on tribal lands pursuant to such compacts.
