A BILL to amend Chapter 850 of the Acts of Assembly of 2018 by adding a sixth enactment, relating to state sales and use tax in the Historic Triangle; sunset; referendum.

Be it enacted by the General Assembly of Virginia:

1. That Chapter 850 of the Acts of Assembly of 2018 is amended by adding a sixth enactment as follows:

That the provisions of the first enactment of this act shall expire on July 1, 2026, unless approved in a referendum held and adopted within the City of Williamsburg and the Counties of James City and York. Such referendum shall be held in accordance with § 24.2-684 of the Code of Virginia and initiated by a resolution of the Williamsburg City Council, the James City County Board of Supervisors, and the York County Board of Supervisors. The clerk of the circuit court of the three localities shall publish notice of the election in a newspaper of general circulation in the locality once a week for three consecutive weeks prior to the election. The tax shall be continued only if the voters in each of the three localities affirm the continuation of the levy of the additional sales and use tax set forth in § 58.1-3833 of the Code of Virginia, as amended by this act.
