Be it enacted by the General Assembly of Virginia:

1. § 1. In consequence of the ongoing leaks in the Midtown Tunnel and defective maintenance of both the Downtown Tunnel and the Midtown Tunnel, the Virginia Department of Transportation (the Department) shall enter into negotiations with Elizabeth River Crossings for the termination of the contract related to the Downtown and Midtown Tunnels across the Elizabeth River due to breach of contract. If the Department is unable to negotiate satisfactory terms for the termination of such contract due to breach of contract, the Department shall enter into negotiations to either (i) exercise the Department's right to terminate the contract for convenience or (ii) purchase any or all of Elizabeth River Crossings' interest in such contract.
