VIRGINIA ACTS OF ASSEMBLY -- CHAPTER
An Act to authorize the reestablishment of a general hospital in Patrick County.

Be it enacted by the General Assembly of Virginia:

1. § 1. That, notwithstanding any other provision of law, the State Health Commissioner shall accept and review applications for and may issue a license to an acute care hospital located in Patrick County that was previously licensed as an acute care hospital under a license that was valid and in effect prior to December 31, 2018.

§ 2. That, notwithstanding the requirements of § 32.1-102.3 of the Code of Virginia and regulations of the Board of Health, the reestablishment of a general hospital with up to one magnetic resonance imaging unit, one computed tomographic imaging unit, 25 inpatient beds, and two operating rooms in Patrick County shall not constitute a project for the purposes of the issuance of a certificate of public need, provided that (i) the reestablishment is the result of the closure and subsequent sale of a general hospital that was licensed in Patrick County prior to December 31, 2018, (ii) the previous general hospital in Patrick County had been issued a certificate of public need or did not require a certificate of public need at the time at which the project was first commenced, and (iii) the reestablishment of such general hospital occurs within seven years of the date of the closure of the general hospital in Patrick County.

A BILL to allow the Patrick County Board of Supervisors to enter into a contract for an investigation of the feasibility of reopening the Pioneer Community Hospital of Patrick County, in whole or in part, or establishing alternative locations in Patrick County and surrounding localities at which necessary health care services may be provided.

Be it enacted by the General Assembly of Virginia:

1. § 1. That the Patrick County Board of Supervisors may enter into a contract to investigate the feasibility of reopening the Pioneer Community Hospital of Patrick County, formerly known as the R.J. Reynolds Patrick County Memorial Hospital, to provide health care services, including emergency medical and rural health care services, necessary to meet the needs of residents of Patrick County and the surrounding localities. In conducting its investigation, the entity with which the Patrick County Board of Supervisors has entered into a contract shall evaluate the feasibility of (i) fully reopening the Pioneer Community Hospital utilizing the existing structure in its entirety to provide necessary health care services, including emergency medical and rural health care services, and (ii) utilizing a portion of the existing structure, which may include the recently renovated emergency department, to provide telemedicine services, emergency medical services including triage and transport services, imaging services, or other health care services necessary to meet the needs of residents of Patrick County and surrounding localities, either in connection with an existing local or regional hospital provider or as a stand-alone facility. Any investigation undertaken pursuant to this act shall be complete by October 1, 2023.

§ 2. The contract authorized pursuant to § 1 may include a provision that if the entity with which the Patrick County Board of Supervisors has entered into such contract determines that it is not feasible to use any portion of the structure of the Pioneer Community Hospital to provide medical services necessary to meet the needs of residents of Patrick County and surrounding localities, the entity shall identify alternative locations in Patrick County and the surrounding localities at which health care services, including emergency medical and rural health care services, necessary to meet the needs of residents of Patrick County and surrounding localities can feasibly be offered.

Be it enacted by the General Assembly of Virginia:

1. § 1. That the Virginia Department of Health is directed to investigate and examine the feasibility of reopening the Pioneer Community Hospital of Patrick County, formerly known as the R.J. Reynolds Patrick County Memorial Hospital, located at 18688 Jeb Stuart Hwy, Stuart, VA 24171, either fully or in a limited capacity so as to provide emergency and rural health care services by utilizing the existing structure in its entirety, or solely utilizing the recently-renovated emergency department, either in connection with a local hospital provider, a regional hospital provider, or as a stand-alone facility to offer telemedicine, EMS services such as triage and transport, imaging, and other patient care items for Patrick County and the surrounding localities.

2. § 2. If the Virginia Department of Health determines the reopening the Pioneer Community Hospital of Patrick County is to be infeasible, then the Virginia Department of Health is directed to investigate and examine alternative locations for the previously stated healthcare and EMS service needs of the community, such as the Patrick County Dialysis Center located at 221 Rich Creek Drive, Stuart, VA 24171, the vacant building located at 110 E Blue Ridge Street Stuart, VA 24171, and any other feasible locations within Patrick County.

3. § 3. The Virginia Department of Health shall report its findings, conclusions, and recommendations to the Senate Committee of Education and Health, and the House Committee on Health, Welfare and Institutions by October 1st, 2022.
