VIRGINIA ACTS OF ASSEMBLY -- CHAPTER
An Act to amend the Code of Virginia by adding a section numbered 46.2-803.2, relating to trucks; operation in certain weather conditions.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 46.2-803.2 as follows:

§ 46.2-803.2. Operation of heavy trucks in certain weather conditions.

A. When driving a truck or truck and trailer or semitrailer combination with a gross weight rating greater than 26,000 pounds during active snow, sleet, or freezing rain, the operator:

1. Shall not utilize cruise control; and

2. Shall not utilize compression release engine brakes.

B. This section shall not apply to the operation of pickup trucks or panel trucks.

C. No law-enforcement officer shall stop a motor vehicle for a violation of this section. No evidence discovered or obtained as the result of a stop in violation of this subsection, including evidence discovered or obtained with the operator's consent, shall be admissible in any trial, hearing, or other proceeding.

A BILL to amend the Code of Virginia by adding a section numbered 46.2-803.2, relating to trucks; operation in certain weather conditions.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 46.2-803.2 as follows:

§ 46.2-803.2. Operation of heavy trucks in certain weather conditions.

A. When driving a truck or truck and trailer or semitrailer combination with a gross weight rating greater than 26,000 pounds during active snow, sleet, or freezing rain, the operator:

1. Shall, if reasonably possible and conditions safely permit, drive the vehicle in the right-most lane of any highway having two or more lanes in each direction;

2. Shall not utilize cruise control; and

3. Shall not utilize compression release engine brakes.

B. This section shall not apply to the operation of pickup trucks or panel trucks.

C. No law-enforcement officer shall stop a motor vehicle for a violation of subdivision A 2 or 3. No evidence discovered or obtained as the result of a stop in violation of this subsection, including evidence discovered or obtained with the operator's consent, shall be admissible in any trial, hearing, or other proceeding.

§ 46.2-803.2. Operation of trucks in certain weather conditions.

A. When driving a truck or truck and trailer or semitrailer combination during active snow, sleet, freezing rain, or other cold inclement precipitation, the operator:

1. Shall drive the vehicle in the right-most lane of any highway having two or more lanes in each direction;

2. Shall not utilize cruise control; and

3. Shall not utilize compression release engine brakes, commonly known as Jake brakes or Jacobs Exhaust Brakes.

B. This section shall not apply to the operation of pickup trucks or panel trucks.
