Without objection, by for the day. Mr. Speaker and members of the House, joining us are the members of the civil air patrol, Virginia wing. It was is -- assembled by civil aviators and established on December 1, 1941. This year, they're celebrating their 75th year anniversary and we passed a resolution honoring that milestone during this session of the general assembly. I'd like to ask them to stand. March is also womans' history month. Today we have a woman of note who is also a part of the civil air patrol. Miss Virginia Lee bloom. Miss bloom is a native of Richmond. She joined civil air patrol in 1943 when she was just 13 years old. She's now 85 years young, and a recipient of the highest civilian honor awarded by congress, the congressional gold medal awarded to her for her service in world war ii. Members of the civil air patrol Virginia wing risked their own lives by conducting rescue missions and patrolling the coast in search of nazi german submarines. Today, they are Head quartered here in Richmond, comprised of 24 local units and promotes aerospace education, emergency assistance service and youth engagement, its cadet program, and we have some with us, provides training through lessons of leadership and personal ethics. We have with us the wing commander for Virginia and major borgening, the emergency services officer for coastal Virginia. I would like to yield to gentleman from Prince William, Delegate Anderson, who is also a member of the civil air patrol.

Thank you, Mr. Speaker. I appreciate the opportunity and willingness of the gentle woman to permit me to speak perhaps from personal experience about these great men, women and cadets. The civil air patrol was founded on December 1, 1941, just six days before the attacks on pearl harbor in order to harness general aviation assets across the states. Those assets have been grounded by general orders of the president because of the threatening war environment and potential impact here domestically. The office of civilian defense harnessed the organization and employed them throughout the war effort in flying over 500,000 hours of war time emergency missions, and in the course, 64 civil air patrol airmen lost their lives on war time missions. The organization's first task came with an program called coastal patrol which was a period of time when the united states navy had assets to patrol off the eastern coast and gulf coast for submarines that were sending american shipping to the bottom within site of vacationers. The civil air patrol flew those missions and sunk two nazi u-boat submarines and today performs noncombat missions at the direction of the secretary of the air force. I was privileged and the reason the gentle lady yielded to me safely to serve three years as national commander of this organization which consisted of 17,000 units and 60,000 members across the country and selected locations. Today, the organization has a cadet program, and an aerospace program in the public schools across the country. Today, they fly homeland security missions in the Washington, d.C. Area, these are labelled as operation mobile eagle missions by the united states air force and selected air crew members have security clearances in order to do that. So with that, Mr. Speaker, and gentle lady, I appreciate the opportunity to speak about the grit men and women of the civil air patrol. [ applause ].

Mr. Speaker, we lost a great lady with the death of nancy Davis reagan. I was deeply saddened to hear the news because like others here, who were adults when president reagan and nancy were in the white House we had a chance not only to see a great president but a first lady and also, witness one of the most genuine love stories in america. The reagans were simply besotted with joy to be with one another, their love was abiding. When the president was away for extended periods of time, on travel, he would tell his security team I want to get back to nancy. Many testimonies are now pouring in about the love they shared for one another. But the best testimony is from ronald reagan himself, following his recovery and near death at the hands of a would be assassin in March, 1981. This is from Page 12 of the reagan diaries, Mr. Speaker, after describing the attempt on his life, the bravery of the secret service, his trip to the hospital, the incredible pain, his inability to actually catch a breath because of where the bullet had gone, he remembers in the moments after and during his recovery the following, I opened my eyes once to find nancy there. I pray I 'll never face the day when she isn't there. One of the ways God blessed me is giving her to me is the greatest beyond anything I can ever hope to deserve. What a love story, Mr. Speaker. So, Mr. Speaker, I move that when the House adjourns today, it adjourn in the honor and memory of nancy Davis reagan, the former first lady of the united states.

This morning governor mcauliffe announced $812,000 will be awarded to tourism initiatives as part of the tourism leverage program, designed to attract more visitors by leveraging local marketing dollars and will impact at least 153 other statewide tourism entities. The match by a minimum of 2-1 in order to support marketing projects. This funding cycle will match the grant dollars with more than $2.6 million providing more than $3.4 million in new marketing. Research shows that every dollar invested in grants resulted in $16 of direct visitor spending. Marketing campaigns that receive leverage grants increase visitation by 15%. I want to commend the local organizations across the state helping increase visitation by creating marketing partnerships and programs. Our whole state wins when working together to tell the country and world what we all know. Virginia is the best place in the world to live and visit, thank you, Mr. Speaker.

Members May recall that last year we passed legislation commonly referred to as conner's law. This was related to a child support payment for differently abled people over age 18. Ladies and gentlemen of the House we have in the gallery with us today the principal advocate for that law, conner cumming ns with his mom, sharon, and his uncle and cousins mike, jake, and jesse. I'd like to ask them to stand. And what I would like you to know about conner he didn't complete efforts in Virginia he's advocating in maryland and new York and hopes to take this nationally. And so I hope it would be the pleasure of the body to give our guests a warm House welcome.

March is womens history month. It's fitting we celebrate the achievements of women and their place in the history of america in the month of March because over the years, to win rights for women to protect the rights of women, we have had to March. We have marched to win the vote, to be paid equal wages for equal work and to have our rights protected and voices heard. The story of women is defined by change but in very bold, giant leaps. And women have made history in so many important ways. We participated in america's birth but those contributions were lost to us because women were not viewed as significant enough to record them in our history. Women have participated in growth and survival of this great country. We have done it through wars, and helped grow and shape this country. And now, we serve in our political bodies and laboratories and classrooms and work places and we have moved into leadership position. And she won that seat in 1916, 4 years before women were entitled to vote. One of my favorites was sandra day o'conner, from arizona, she served on the supreme court appointed by ronald reagan in 1981. Women have fought for civil rights and social change, we fought for justice for good education for our children and fought to promote public awareness and policy changes that impact our lives every single day. For better working conditions and advanced opportunity for all people, including women. And have shaped generation of children. Thank you, Mr. Speaker. Today I take pleasure in introducing students from higher they're in the gallery today. Achievement program. I ask they'd stand. Higher achievement is an after school and summer enrichment program that connects middle school students to opportunities. Higher achievement students called scholars, spend 550 hours per year working on their academics. In return, scholars form a lasting relationship with staff and boost grades and self confidence. And higher achievement was founded in 1975 in Washington, d.C. As grass root effort to create learning opportunities for children in low income neighborhoods. Since that time it has grown from a single class to four affiliate cities, Washington, d.C., Alexandria, baltimore, pittsburgh and Richmond, Virginia. This is designed to help change the lives of so many young people over the last 40 years, 10,000 young people have been impacted by the program. So I ask the House will join me in just welcoming them to the capitol today. Thank you, Mr. Speaker.

The families came back to us and said we appreciate the bill but don't have a mechanism to get the oil though it's available from other states. That is also illegal. Mr. Speaker, members of the House. This bill deals with a situation where you have a child who has a developmental delay, say autism, and in school, gets charged with disorderly conduct. Because they threw a trash can or something. And the problem is that the kid knows he did it, but he can't help himself because that is the nature of his problem, some school resource officers will charge the kids with a crime and a lot of us believe they shouldn't be charged with a crime, but should be trying to educate the kid. So conventional wisdom would be just a technical amendment to ask you to adopt it and I do feel obligation to tell you there has been a little bit of controversy developed since this bill was last year. The commonwealth attorneys hate this. They do not like it because they believe this bill is creating a what is called a diminished capacity defense. So in Virginia in order to be found not guilty by reason of insanity, you have to be to the point where you don't know what you're doing or consequences of your actions. Here, a kid with autism for example might know he is throwing a trash can, but can't help himself. So what this bill does is for just the classification of misdemeanors, by kids, on school grounds creates arguably a defense called diminished I carried it by because I wanted capacity. The lady to represents the autism meeting and they couldn't I think it's a great bill. Agree. But I wanted to make sure what it was doing. The amendment is merely changing the notice so when the kid goes to court, they have to notify the commonwealth attorney in advance they're going to be using their iep report in defense and it used to be 14 days notice, now, 10 days notice. I hope it be the pleasure of the House to adopt the Senate amendment.

Is there a group with a commonwealth attorney? Because that is all they do is lock peoples up. Is there a second opinion? In most cases when commonwealth attorneys have a case, it's their job just to lock you up, not trying to help folks.

I answer the gentleman in our discussion of the bill, almost everybody liked this except for the commonwealth attorneys. The problem is that commonwealth attorneys in Mr. Dave Albo 's opinion created this problem for themselves because they shouldn't have been prosecuting these kids. We wanted to limit it, carefully, just for kids with developmental delay problems, on school grounds and just for misdemeanors. So we tightened it up.

What happens if that same kid goes out on the street in a department store, for example, the same kid and throws a chair? What happens then?

My original bill included everybody. In order to get it through the House, we wanted to, everybody wanted to make it justified to schools. That is where the problem has been. We have had a bunch of us have been familiar with cases that happened to us as attorneys, and it seems to us a lot of times schools get frustrated with the kids and charge them with a crime, in my opinion, just kick them out of the school instead of educate them. And you do make a good point.

As a lawyer, in this House you're going to court and defending a child who is not in school, can you use the argument that according to code, it's in school and happened off campus, as a lawyer, could you use the argument that should benefit the same kid? .
[Unknown]
I don't think you could. Because the code said the defense is related just to school grounds. How far, you have always been able to use the argument after a determination of guilt. So the way it works is that they have a trial, they determine whether the kid is guilty or not. It's called whether they were delinquent or not. The juvenile court has more discretion to do things. The circuit court call balls or strikes. And in juvenile court, the court is designed for rehabilitation. So after, so in your situation, you're talking about a kid who, say, has autism and got disorderly conduct outside of school. Under present law, an attorney could still argue you should not convict him because the purpose of the juvenile court is to rehabilitate.

As an attorney, if you know that a kid has a problem, I 'm trying to figure out whether it's on school, or off school, and you could problem you know know it's trying and no disease or sickness the kid has. Why are we charging the kid with a misdemeanor and knowing they have a problem.

This is a public safety measure I introduced at the request of michael carera, a member of the mannases park city council, the son of two legal immigrants from south america. The substantive changes embodied in this substitute were deprived from observation by the sheriff's association. When this left the House there was an expressed reference to a compensation agency in the common wealth of Virginia. The sheriffs thought this might be a special favor to a group. So I removed that at their request. The sheriff pointed out it is not just ice individuals who pick up individuals who are requested for detainers. Sometimes, u.S. Marshals. And include the words and the request to hold somebody legally, and this is legal, so we talk about the legal holding according to federal or state law, which is a 48-hour period. So if you like the original bill, I think you should like this one, Mr. Speaker. The effect is making honoring detainers in Virginia to avoid circumstances like kate steinle, who was killed by an illegal immigrant because of the policy of the city of san francisco. I referenced and will repeat that a request of the imgrigss customs enforcement indicated that in Virginia, a 15 month period there were 29 requests for detainers not honored. And half of the people were involved in criminal offenses. So I urge the substitute and amendment, floor amendment, technical amendment, as well.

I am going to ask the House to pass the Senate substitute. This is a fairly complex bill. This is the go Virginia bill, which I think a lot of you remember quickly. There are five changes, frankly they all tighten language up a little bit. But they're on line 106, and adds one member to the state counsel that made a majority and now, if you go to Page three, plenty of sunshine 163, 164, it requires an analytical assistance for post grant assessment and review to evaluate results and outcomes of the grants. It tightens up on the review process of the grants. On Page four, it basically says no more than 90% of money of the funds should be awarded in any fiscal year. You skip to Page six there are two changes. One makes sure you do have to have a one for one match and can score higher for more. And to line 321 requires an audit tightening up the language and last change is an enactment clause. And makes sure this would be staff support that would have to be from a private affiliate. So that is what the Senate substitute does. I hope the House will accept the Senate substitute.
