All mighty God in heaven and comforter on earth, on this president's day, February 16th, 2015, in the year of our lord christ, May each Senator of the commonwealth of Virginia remember the words of our third president thomas jeffer son who said God who gave us life gave us liberty. Can the liberties of a nation be secure when we have removed the conviction that these liberties are the gift of God. I tremble when I reflect God is just, his justice May not sleep forever. May we also acknowledge Black history month started in 1926 by virginian carter woodson to preserve the stories of Black soldiers and heros, to acknowledge the birthdays of two famous americans, abraham lincoln and Frederick douglas. May every one in the chamber practice the words of Frederick douglas. I have one political idea, it is old but is generally tramp himmed on and disregarded. The best expression I have found is in the bible, it is in substance righteousness exalt a nation but sin is many righteous to people. I feel it is my duty to all to do all in my power to infuse this idea in the public mind that it May be practiced, end quote. And finally, May the senators find gratitude in the words of another president from Virginia, James madison, who said no people ought to feel greater obligations to celebrate the goodness of the great dispose your of events and the destiny of nations than the people of the united states and to the same design author of every good and perfect gift, we are indebted for all those privileges and advantages, religious as well as civil which are so richly enjoyed in this favored land. In the mighty name of the redeemer of mankind, jesus christ, amen.

Good afternoon, mr. President. I rise for purposes of an introduction.

Thank you, mr. President. Members of the Senate, in the gallery today we have some very special guests which I 'd like to introduce to you. Up in the gallery we have my seat mate, the Senator from hanover, Senator McDougle 's mother sandy McDougle. There are some names and this is why he gave me these so I could pronounce them correctly, I 'll give them a shot. His lovely mother sandy is up in the gallery as well as his sister mitsy and her children erin and zoe, I asked if they had another child named magic, magic marker -- it's Monday, I 'm trying. Of course, they are being escorted around the capitol by their tour guide regan McDougle who also joined us in our committee, I couldn't focus because she was so cute. I would ask you extend them the warm welcome of the Senate.

Thank you, would members of the McDougle family rise. What a wonderful family you have. Thanks for being with us. I want to let you know there are some that are better behaved than others, I 'm glad to have the McDougle family here because I know that corner will be well behaved. Mr. President, I request a leave of absence for my seat mate the Senator Portsmouth who is away from the capital on pressing personal business.

Joining us are ladies of the first and finest sorority, alpha kappa alpha incorporated. It's aka day at the capitol. It was founded 107 years ago on January 15th, 1908, on the campus of howard university. For over a century this sisterhood has enriched minds and encouraged life long learning, provided aid for the poor, sick and under served, worked collaboratively with other groups and continually produced leaders to continue it's credo to all man kind. It has grown into a force over 280,000 collegiate members constituting more than 980 chapters in 42 state, the district of columbia, germany, south africa, japan, canada and other areas of the continent of africa. Joining us in the gallery are the mid-atlantic regional director joyce henderson, past directors linda and gilliam, dr. Mary and. Please give them a warm pink and green welcome.

I will. Will you please rise. Thanks for taking time out of your busy schedule to meet with us this afternoon. Just a list of the things, the contributions your sorority has made are commendable, we appreciate all the good work you do for the commonwealth. Thank you, with us in the gallery is jamie, in charge of all probation services who is down joining us to testify on a bill. We were reminiscing how things have changed, when I left 2002 from the department of juvenile court. Today we have about 525 lock up, our detention home population, every bed was filled would be 1240. Today somewhere in the neighborhood of 600 to 650. This is real progress. People like jamie are responsible for this in the good programs they are running and I would ask you give him the warm welcome of the Senate.

Thank you, would miss jamie mckaren rise. Thank you, I appreciate you being hereto. Just as the Senator said, the work you all are doing is just so important and a lot of mental illness across the commonwealth, we are trying to find ways of certainly making access easier for those that need that and, so, I 'm sure some of that involves your work as well. Thanks for all that you do. I would ask the members of the Senate to please join me in offering mr. Jamie mckare into warm welcome of the Senate. Mr. President, first I would ask you to recognize and to welcome a group who are the grandparents, parents and siblings of lanie, one of our pages and accompanying the group are mr. And mrs. Paul and ann who are parents of lanie, if you would extend a welcome to them.

Would you please rise? Welcome to the gallery and thank you for allowing your grandchild lanie, your daughter, I 'm sorry -- it says grandparents on here. If you all would please rise as well. Welcome and our page program is just a great program as you know, so I was in the process of thanking you for allowing your daughter to be one of our pages and as is the case each year we have a wonderful group of young scholars and they are so instrumental helping us get through the day do the things we need to do. Hard to believe we are almost finished, in two weeks she will be returning home with you but we have certainly appreciated her being with us. I would ask the members of the Senate to please join me in offering the family of all lanie warm welcome of the Senate. [applause] he the senior Senator from henrico, Senator Stosch.

I would also ask you to acknowledge the presence and welcome some young friend of mine, they are ava and hailey walker, he'll mental tear student from carver elementary school, they are visiting the capitol, they are joined by their mother emily, she is the governor's affair president of the cpa.

Will the walker family please rise? Welcome to the gallery this afternoon and, you know, I think it's a good day for you all. I guess you are out of school today for president's day and tomorrow you May be out of school as well if things happen like are predicted, so it's a great time for you to come to the capitol and see how things work and learn a little about the history of Virginia, so best of luck in your academic achievements and I 'm hoping, I 'm keeping my fingers crossed you will be out of school tomorrow as well. Mr. President, continuing with the theme of family day at the Senate today, I want to recognize and have you recognize a large group of relatives, they are not my relatives but they are the children, grandchildren, great-grandchildren and other assorted relatives of another member of the body here. I would call on mary and gary, mary and pat, bo and ruth willis, rea and drake, mary, anthony and kennedy, dot, jeff and colleen and a tip pat, deedee Colgan are all here to represent the family of chuck Colgan. Welcome to the gallery and thanks for all the work that you are doing, it a well kept secret here in the Senate but I 'm a pediatric neurologist, most of them don't know that but I take care of a lot of children with dyslexia. A lot of folks don't realize a lot of us and people around us are affected with dyslexia and all they need is a little help getting them headed in the right direction with their education, reading and learning and those type things. this is once of the many special license plate bills, this one to help with cure childhood cancer. Mr. President, the only unusual thing about this bill is that it does have an emergency clause. The dmv has already made up the plate and feels comfortable with the emergency clause. In this case the required signatures are already in hand for over 700. I believe the gentle lady from loudoun would like to speak on it, I would yield to the junior Senator from loudoun.

Thank you, mr. President. This bill is a big deal in my part of the world and these license plates will work thanks to a young man who went to school with my boys. Back in 2012 he was just an average Loudoun County fifth grader, he was an avid soccer player so when his leg started hurting him his parents thought it was a minor sports injury but when it didn't improve his mom took him to the doctor and so began the long journey that has brought this bill before you today. He was diagnosed with osteocarcoma, he had to have part of his leg amputated and he began a grueling cycle of more than 20 chemo. His parents were shocked the national cancer institute spent $525 million researching breast scanser and only $22 million on pediatric cancer. They bought a new car to take him to out of state. When she went to the dmv to get a license with a gold ribbon for pediatric cancer, she was told they didn't know what they was talking about. He thought that was ridiculous. I'd sad to report that he passed away on December 7th, 2014, though he won't be here to see this bill become a law but when he was presented with an enrolled copy of his bill he expressed his opinion that this is epic. So ladies and gentlemen, I ask that you please pass this bill, arntiond mr. President, when we a journey ask we adjourn in memory of medias.

1955 it's one of a number of bills that the crime commission had been examining as it relates to illicit and untaxed cigarettes. This says the attorney general's office shall develop and publish a list on its website individuals who are not permitted to be holders or sellers of cigarettes and further indicates in the bill under the definitionary section, individuals who are currently precluded from holding the cigarette sales license but also adds in some new offenses which are primarily criminal offenses that would disqualify them from doing that. With that I ask the bill pass.

Mr. President, I rise to speak against the bill. I actually voted for it in committee. To be clear the criminal offenses that it adds to prohibit one from being a holder of cigarettes include any activity designed to sub verb the taxes of another locality or state, so, in other words eric garner was trying to sell one lose cigarette, he couldn't run a convenience store. That's the plain meaning of the bill. And, again, we have seen a wave here in Virginia of legislation designed to make it easier to enforce ill informed laws that quite literally in this instance cost lives in other states and as such, while I did vote for it in committee, I will be voting against it.

Mr. President, the bill addresses policies on course credit at public institutions of higher learning. Presently we leave it up to the individual institutions to do that, we are tilling them they need in consultation with the schools to develop the policy and implement it uniformly across the state. It has a delayed effective date of July 1 and, again, it repeals the section that gives each of the schools the ability to do it on it's own rather than having them coordinate it. I again ask that you support the bill.

thank you, mr. President. Wow. The concept is great and I support the concept and I spoke with the patron prior to this bill coming out of committee and they said they had no problems working with chev. There is one truth, that is in a state with spectacular community colleges and colleges and universities, they are not all the same. And, so, what this bill would do is establish a baseline score which an university would award a credit for passing an exam. We May say if you score 17 out of 20 you get credit for the course and the contention by some people is what william and mary desired to reward credit for a high school course May be different from what uva which May be different george Mason. The concept that was batted around as I tried to hip the patron with the bill was, hey, why don't wet establish a tier system, a group of university could be tier 3 and award credit at 15 score and a tier 2 could award credit at 17 and maybe another could be tier 1 and award credit at 19 but not make universities give uniform credit to uniform achievement when we don't have uniform colleges and universities. I think the idea is good and would help a young person applying to a Virginia college university to know if I score this on this advanced placement exam I will be able to opt out of western civ or baby bi -- oh you like that one? Right now the idea is good but it not ripe insofar as we shouldn't be treating all our four-year institutions as if the prerequisites are academically the same. With that in mind I think it's a good intentioned piece of legislation whose time has not come and I would urge you applying a draconian set of standards that might work at one university and not at another.

Mr. President, this bill comes to us out of the commission on youth and it seeks to address an issue that exists around the state as is brought to our attention. It requires the board of education to adopt regulations on the use of seclusion and restraint in public schools in secondary schools. It requires them to be p consistent with criteria for use, restrictions for use, training requirements, notification requirements, reporting requirements, follow-up requirement and address distinctions between certain student population. It is recommended by the Virginia commission on youth and I ask you support the passage.

Thank you, mr. President. Speaking to the measure. This is exactly like my Senate bill 1782 which passed the Senate on a vote of 35 to 4. I just every mind the body that 32 other states have some type of statute or regulation on the books dealing with seclusion and restraint. What this bill does do is in addition to everything Senator Martin explained, it will also require that we conform to federal guidelines and I want to note that private schools in Virginia are already obligated to follow regulations regarding seclusion and restraint.
